By accessing or using Marlwood Planning Intelligence ("the Service"), you agree to be bound by these Terms of Service.

1. Use of the Service

Marlwood provides AI-powered property development feasibility analysis and planning intelligence tools. The Service is intended for use by property developers, town planners, and related professionals operating in Australia.

2. Account Registration

You must register an account to access the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

3. Disclaimer of Planning Advice

The AI Town Planner and all planning data provided through Marlwood are for informational purposes only. They do not constitute formal planning advice, legal advice, or a substitute for professional consultation. Always verify planning information directly with the relevant council and engage qualified professionals before making development decisions.

4. Data Accuracy

While we strive to provide accurate planning data sourced from council and government databases, we do not guarantee the completeness, accuracy, or currency of any information displayed. Property data, zoning information, and overlay details should always be independently verified.

5. Subscriptions and Payments

Paid plans are billed monthly via Stripe. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. All prices are in Australian Dollars (AUD) and are inclusive of GST where applicable.

6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt to access data belonging to other users
Abuse the AI copilot or property search through automated scripts or excessive requests
Reverse engineer or attempt to extract the source code of the Service

7. Intellectual Property

All content, design, and software of the Marlwood platform are owned by Marlwood. Your CRM data and saved properties remain your property.

8. Limitation of Liability

To the maximum extent permitted by Australian Consumer Law, Marlwood shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to financial losses from development decisions made based on information provided by the platform.

9. Termination

We reserve the right to suspend or terminate accounts that violate these terms. You may delete your account at any time by contacting support.

10. Governing Law

These terms are governed by the laws of Queensland, Australia. Any disputes shall be resolved in the courts of Queensland.

11. Changes to These Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms.
